Joyce's 365K

I acknowledge that running a road race is a potentially hazardous activity, which could cause injury or death. I will not enter and participate unless I am medically able and properly trained, and by my signature, I certify that the participant, whether myself or the minor for whom I am the legal guardian, is medically able to participate in this event, in good health, and properly trained. I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read these terms and will abide by them. I assume all risks associated with running in this event, including but not limited to: falls, contact with other participants or passersby, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road, acorns, pinecones, twigs, rocks, olives, small squirrely animals, geese, ducks, etc., and other running hazards, all such risks being known and appreciated by me. Having read this waiver and knowing these facts and in consideration of accepting my entry, I, for myself or anyone entitled to act on my behalf, waive and release Joyce’s 365K, the City of Fremont, all event sponsors, their affiliates, their representatives and successors from all claims or liabilities of any kind arising out of my participation in this event on December 31, 2026, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. I grant permission to Joyce’s 365K to use my photographs, motion pictures, recordings or any other record of this event for any legitimate purpose. I hereby release and agree to hold Joyce’s 365K harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, of the event, or that may otherwise arise in any way in connection with Joyce’s 365K. I understand that this release discharges Joyce’s 365K from any liability or claim that I, my heirs, or any personal representatives may have against Joyce’s 365K with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to Joyce’s 365K. This liability waiver and release extends to the event together with all participants, family and volunteers, City of Fremont and park staff, sponsors and partners, park visitors and their pets.
